Alina Habba has resigned as New Jersey's top federal prosecutor. This follows a legal ruling that challenged her eligibility to hold the office.

Official Departure

The head of the Justice Department, Pam Bondi, announced her stepping down on Monday. Bondi stated that the judicial decision made it impossible for her to lead the department effectively.

"But do not mistake adherence to the ruling as defeat," she declared. "The effort will now stretch across the country."

Judicial Challenge

The departure comes a week after a US appeals court ruled that she had been acting without proper authority as the top prosecutor. This judgment is expected to impact scores of criminal cases in the state.

The court said that a interim role that bypassed Senate approval breached the statute on vacant positions.

Ongoing Legal Battle

Bondi said that Habba will remain at the DOJ as a senior adviser. She will pursue additional appeals of the ruling, aiming for a overturned decision.

Writing online, Bondi wrote that the court "should not be able to override the executive's selection of attorneys entrusted with performing the fundamental role of the presidency of enforcing the law."

Performance in Office

She highlighted her tenure and said that under her leadership, the Newark saw a 20% reduction in offenses. She also stated that the southern city of Camden recorded its initial homicide-free summer since 1974 without a homicide.

Background and Previous Role

Habba, 41, originally became part of Trump's personal legal team in recent years. She later acted for the former president in his business records case in the previous year, which resulted in his conviction on multiple felony counts of financial record manipulation.

Prior to assuming the federal prosecutor position, Donald Trump had revealed he was selecting her as his White House advisor during his second administration, labeling the lawyer as "unwavering in her loyalty" and a relentless legal advocate.
